About us

Law Firm Szczerba & Kasiński Kancelaria Radcy Prawnego i Adwokata

OUR LAW FIRM

The ?Szczerba & Kasiński Kancelaria Radcy Prawnego i Adwokata? Partnership was established in response to market needs of local businesses seeking comprehensive legal services available both for Poland and in foreign markets, in particular Germany, France and Switzerland. Drawing on over eight years of experience gathered in Poland and abroad and being representatives of both legal professions – legal counsel and advocate – we provide a unique alternative to other law firms operating in the Lower Silesia region.

In the past, both partners worked with difficult and demanding projects, e.g., in the area of competition (anti-trust) and consumer protection law, including distribution contracts, real estate market transactions, IT and New Technologies law, and corporate legal services for companies operating in Special Economic Zones.

An important aspect of our legal business is cross-border litigation. We work closely with foreign law firms to provide comprehensive legal services, in particular in Germany, France and Switzerland. What sets us apart from the competition is the multidisciplinary education acquired at German, French and Swiss universities. Our advantage is in-depth knowledge of not only Polish law, but European and German law, which enables us to provide legal advice on complex projects at the interface of several legal systems and to effectively pursue cases involving entities with their residence address or statutory seat abroad.

Within our specialization we also provide legal advice to non-business individuals. We deal with complex real estate cases, including succession and posthumous distribution of property where both Polish and foreign nationals are involved.

Our working languages include English, German and French.

OUR RESOURCES

Every day we use all the skills, experience, and know-how acquired throughout the years when we were working and living in Germany, France and Switzerland, as well as while providing legal advice to foreign clients in Poland. Being proficient in languages and knowing local cultures and customs, we are able to offer top level service both in Poland and in cross-border situations. We take full advantage of modern management tools, reducing time and cost for our legal services.

OUR MISSION

To ensure top-quality, personalized legal services adapted to the individual needs of clients, we provide innovative and creative legal solutions that ensure adequate conditions for continuous development and growth of their businesses.

OUR VISION

To build a reputable international network of law firms specialized in comprehensive cross-border legal services as an alternative to multinational corporations.

OUR VALUES

Professionalism ? Being law enthusiasts and having multidisciplinary educations and wide-ranging experience gained over the years, we are able to provide top-quality services that are improved even further both from the division by specialization of work and each member?s genuine commitment to our team. We think and work creatively and unconventionally. We take particular care to adapt our proposed legal solutions to the actual business needs of our clients in line with applicable laws and regulations.

Partnership ? We strongly believe that at the heart of every relationship, even business relationships, is mutual respect, trust and responsibility. We build long-term relationships both externally with our clients and internally among our team members, particularly focusing on open-minded thinking and freedom of expression. We offer loyalty and reliability as the foundation of our relationship and we promote clear and transparent cooperation.

Social Responsibility ? Our team recognizes the particular role of lawyers as representatives of a profession of trust, responsible for applying justice and improving legal awareness among members of society. Our attitude and practice is founded on the principles of legal deontology and by offering pro bono legal advice to businesses in cases of serious breaches of the law, we strive to implement the principles of social justice, equal opportunity, and equal access to quality legal services.

TRAINING ?Contracts in Commercial Transactions?

For businesses, contracts serve an all-important role as the legal basis for their income. Nowadays, contracts can be entered into not only in writing or orally, but also by means of modern technology, e.g., electronic mail or instant message. Therefore, both managers and staff should know the basics of entering into contracts, their basic contractual rights and duties, the consequences of improper execution of contracts, and the options for terminating them.

Our training is intended for business owners and their employees, and the basic objective is to introduce you, step by step, to the process of effectively entering into contracts in Poland, including determining when to enter, how long should be the duration, and what contract model is most appropriate. At our training sessions, we discuss the matter of legal representation and basic methods for screening businesses and verifying their solvency, and we also consider best practices for implementing contracts and requirements those parties must comply with in order to secure their rights in case other parties improperly execute their obligations. Our training might also become the basis for introducing relevant procedures of entering into and securing contracts at your company.

Our training is based on workshops where participants discuss situations that they actually experienced in their workplace. We can adapt the training agenda to individual business needs, such as specific legal issues or specific contract types.

Cooperation

Transparent Cooperation.

We build sustainable relationships using the following cooperation models.

Ad hoc legal services.
When you need a one-time consultation or a simple piece of legal advice, or if you just want to sample the quality of legal services we provide.
01
Regular legal services for business entities with no fixed subscription fee.
The ideal solution for clients who need permanent arrangements for legal support provided from time to time with no fixed subscription fee, or for the occasional client who would prefer to have a pre-arranged framework of cooperation with our Law Firm. In this case we apply an hourly rate or we individually assess the price for a given legal service.
02
Regular and comprehensive legal services for businesses.
This is the widest range of services that we offer for a subscription fee determined either on an hourly basis or as a retainer, depending on the estimated workload. This service package is ideal for clients who need regular legal support. This level of close cooperation between clients and our Law Firm reduces the time and cost of providing legal support. Since the resources of the Law Firm are reserved, the legal needs of our client are handled as priorities.
03
In-house support for complex projects.
When your staff needs to be supported by our Law Firm?s expertise and experience, or when it is an emergency situation and you are lacking competent resources, this is a perfect solution. This option is designed especially for those who carry out complex projects that require advanced knowledge and experience, or for situations where your own legal compliance staff is overloaded with other work.
04

We can provide services at our head office or on the client?s premises, or in other locations indicated by the client (courts, notary offices, contract negotiation rooms, etc.), and also in the head offices of partner law firms in foreign cities such as Frankfurt (Oder) and Berlin.

Our legal services can also be provided through electronic mail, telephone conference, and videoconference, or other on-line platforms preferred by the client.

We offer clear and transparent settlement methods and legal products tailored to the individual needs of our clients.
Hourly fee + CAP time limit
Hourly fee + CAP time limit
This is the most suitable settlement method for emergency or one-time legal advice where the scope or volume of the related workload is difficult to estimate.

The hourly rate is negotiable and depends on the complexity of the case and the volume of services that are to be provided.
For certain cases it is possible to cap the maximum number of service hours (CAP); our fee in this payment situation is calculated on an hourly basis, but our work will not exceed the budget limits agreed on beforehand.

The hourly fee is used for cases where it is not possible to estimate in advance the workload of our Law Firm.
Fixed fee
Fixed fee
Fixed fees are agreed upon individually with clients for cases where the workload can be estimated, and the nature and complexity of the case can be considered in relation to the specific experience of our Law Firm. This model is used particularly in the sale of our Law Firm?s package products.
Retainer fee for regular legal services
Retainer fee for regular legal services
This settlement method guarantees regular and continuous availability of our legal services in all areas that our Law Firm specializes within precisely determined budget limits.

The budgeted amount can be fixed or can be calculated on the number of hours declared by the client for a given settlement period in accordance with an agreed hourly rate. In this work model, we give our clients a lower preferential hourly rate.
Success Fee
Success Fee
Success fee amounts are calculated based on the beneficial effects of the work of our Law Firm; our fee is based on us achieving a specified goal.

In this model, we take over a part of the risk of failure, which naturally provides an increased incentive to achieve the results expected by the client. This scheme also applies both the retainer fee system and the hourly fee system, calculated mostly to compensate for court and administrative dispute costs.
Court Cases
Court Cases
Terms of cooperation are determined in a flexible manner taking into account the type and complexity of the case and the procedural situation of the client.

Depending on our projected involvement, our services are charged upfront at the moment we take on a case. We later also charge the client for specific procedural actions taken afterwards using our standard settlement method, e.g., hourly fee, fixed fee, or fee calculated for each subsequent date of trial.

In order to reduce costs, it is possible to spread the risk between the client and our Law Firm and to agree on a success fee to be paid upon favorable completion of the case.
